Thank you for using Lyme services. To enhance your experience, for a limited amount of time, we are assigning new users a Queen subscription, free of charge. We would like to welcome you to our platform and we hope you have a good experience using it. Our services are provided by Rúbrica Promissora, Lda., a Portuguese company based in Travessa da rua 3, nrº 5 r/c direito, 4730-460 Vila de Prado, Portugal. By using our services, you are by all means accepting the terms hereby stated.
Using our services
When you open a Lyme account, you will provide personal information such as your name, email contact and a personal access password. In this regard, you are consenting the collection of such personal data for its inclusion in Lyme's database. For more information on this theme, check our tab on privacy. Using our services and opening an account does not give the user any rights or property over our services or platform. Please use our services in a way you can obtain the maximum advantage from them but within the limits of a responsible utilization. Do not try to access our services by other means not contemplated by the platform. Any detected attempt to break the security or hacking our user accounts will be severely punished by law. We can send you some information about our services or your account that we consider useful for the best use of Lyme. Newsletters or other kind of notifications, will only be send if the user subscribes them, and they can be unsubscribed at any time. Not knowing our terms of use or privacy policy will not decrease by any means your liability of well use our services.
Your Lyme account
To access and use our services every user needs an account. The account is created directly by the user when accessing our services for the first time. However, certain accounts, can be part of a business account. On that case, the account will be associated to the business account by the business account manager. The business account administrator is the person in charge of the business account and, normally, is also the person who creates the business account. An account can be created through any email. There can exist some accounts with specific characteristics directly assigned by Lyme. Lyme is free to decide to whom these accounts can be assigned. Your account is private and not transmissible. To assure that no one else besides you can enter your account, be sure you have a strong password and that you keep it secret. We advise to not use the same password in several platforms or apps.
The content
Lyme is only a message delivery and certification platform. Lyme is not responsible for the content of the messages. All the content sent and delivered in the messages Lyme processes are from the exclusive responsibility of the owners of the accounts. Lyme cannot be charged upon any losses or damages or any harm that the content of the messages can cause. When a user sends a message though Lyme, he uploads or stores information or data in our servers to process, log and deliver, however, that information or data still belongs to the account owner. When you upload, store or use Lyme in any way with your information or data, you are transmitting Lyme the authorization to process that information the way Lyme finds best and correct. No losses or harm can be asked Lyme for processing that information or data. Some of the information that you post in your account, can be seen by your contacts, like your name, email or photo. When you subscribe an account, you authorize Lyme to use your account activity to analyse the statistics of the messages' performance.
Service changes and terminations
At Lyme we always want to improve. Doing everything possible to deliver our users the most accurate log will sometimes introduce some changes to the service we provide or to the aspects of our interface. Lyme is totally free to introduce that kind of changes or other changes that Lyme thinks are necessary by its own initiative without any kind of pre-warning to the user. These changes shall not cause any losses on the information or data of the users and, even if Lyme has the liberty to introduce them without any pre-warning, we will, most of the times, inform the users about any change that we introduce. All that has been said regarding changes on the service or the platform, is also valid in case of interruption or termination of any service provided by Lyme. Lyme can also stop supplying all or part of the services to a user, or can, at any time, add new requirements that the users must fulfil to continue using the platform.
Disclaimer
We try, by all means, to supply the best service possible to please our users and to deliver a high accuracy log of the messages sent through Lyme. However, Lyme doesn't compromise itself to delivering nothing more than the services we perform. In other words, the Lyme service is exactly what it is, nothing more should be expected. That way, in a way that no law is broken, we exclude any guaranties over our service.
Liability
Lyme will not assume any responsibility for any direct or indirect harm or loss, profit or financial losses, or losses of any other kind that a user can possible have for any reason. Any complaints regarding losses connected with the terms hereby presented, are limited to the amount the user has paid for the service, if he has paid any amount, and only if after an accurate analysis made by Lyme is it considered that some fail or fault on the service provided has in fact occurred. In any way, no more that the amount paid by the user can be asked to Lyme and only if the problem was not generated by some kind of use that was not reasonably predictable by the user.
Guarantee
Lyme offers a guarantee of 10 times the minimum value advertised on logyourmessage.com for the cost of a LymeStamp, in case of loss, theft or deterioration of the message up until the moment of delivery and emission of the log of that same message, as long as there's irrefutable evidence of such loss, theft or deterioration.
About our terms
Lyme can change these terms by its own will whenever it feels appropriate. The user should consult these terms regularly in order to be aware of any change that Lyme may introduce. All the changes will be announced with at least 5 working days before they enter into force. If any user doesn't agree with the terms in force after any change, he should abandon the service. If there is some kind of conflict between these terms and any additional terms referring some special services, the additional terms will prevail over the terms hereby stated. If some of these terms are against any law of any country, the legislation will always prevail over these terms. If any legal dispute may occur, the declared court to settle it will be the Braga court, Portugal. By using Lyme services and messages' platform all users are accepting unconditionally these terms, the way and court to settle them.
Your Lyme account
As a condition of access to the Lyme - Log your message platform, you will be asked to create an account with your email and a password to be preferentially only used in the platform and it will be, from this moment on, considered as your standard way of access to Lyme. The security of access to our platform also depends on measures taken by the user. You should therefore keep your password in a safe place to not compromise the confidentiality of your data. Account passwords are encrypted, which means the Lyme team doesn't have access to your password. In this sense, when forgotten, you'll be asked to set a new one.
Account verification
All accounts registered on Lyme - Log your message, are scrutinized by the technical team so that only the user of that email can send registered messages from it and so that there's no identity theft. Users are required to have a true human identity, otherwise Lyme reserves the right to delete their accounts.
Personal data collection
Safety is a top priority on the Lyme - Log your message platform, and our mission is to adopt safety standards, including:- Demanding you to set a password to gain access to your account on our site;
- Using a Secure Socket Layer (SSL) certificate to encrypt the personal data you send us during the ordering process, including any financial information such as credit or debit card details;
- Not keeping your credit or debit card details, such as the CCV security number, that could allow a third party to make transactions using that card;
- Regularly monitoring our servers and computer systems to prevent vulnerabilities and attacks.
Encryption and privacy of information
All content submitted on Lyme – Log your message is encrypted to offer total privacy to our users. As such, the information circulating on it is confidential and even Lyme's technical team doesn't have access to messages received or sent through the platform. Lyme doesn't store the registered messages on the server beyond the period defined in the conditions of each subscription.
Data breaches and hacker attacks
In case of breaches of personal data (e. g., improper access or loss of data, which is extremely difficult to happen, but not impossible at all), Lyme will immediately notify the Portuguese Data Protection Authority (CNPD) and also data holders (i. e., people affected) within a maximum period of 24 hours. Lyme safety measures shall, in the light of the available technical knowledge and the costs resulting from its application, guarantee a level of safety appropriate to the risks presented by the treatment and the nature of the data to be protected.
Verified sender
In some instances, in the new message notification email, the sender has, next to his name and email, a blue symbol with a white check indicating that user has successfully completed the process of identifying and confirming the veracity of his data and contacts by the Lyme technical team. This guarantees you are in fact dealing with that entity.
Time stamp
The time stamp is a chronological validation process that attests the date and time of an action. The time stamps on Lyme prove the immutability of the log file.
Privacy
Lyme seeks to solemnly protect your privacy. But first, Lyme needs to obtain an express acceptance of the collection of your personal data. Therefore, this whole process has your direct interaction by clicking on a link provided through the activation email, to create your personal account on Lyme. This privacy policy describes the way the website logyourmessage.com collects, uses, stores and discloses the user information. This privacy policy applies to the website and services offered by logyourmessage.com.
Personal information
We collect personal information from users in several ways, including, by not limited to, when they visit our website, when registering on the website, and when they use the services we provide. Users may be asked, depending on the case, name, email address and eventually, other data. Users can, however, browse our website anonymously. We only collect personal identifiable information if they voluntarily submit such information. Users may at any time refuse to provide personal identifiable information but will prevent them from properly enjoying the features of the site.
Personal information sharing
This privacy policy rules exclusively the relationship between Lyme and you. They don't create any rights for third parties, because there aren't. We don't sell, exchange or rent users' personal data to third parties. We may share generic demographic information not connected to any users and visitors' personal information with our business partners, trusted affiliates and promoters for promotion and fundraising on our platform.
Non-personal information
We collect non-personal information from the users whenever they interact with our website. Non-personal information can include the name of the internet browser, computer technical information, internet connection type, operative system, internet provider, and others.
How we secure your information
At Lyme, we have adopted an appropriate collection and storage policy, processing practices and security measures to protect against the unauthorized access, alteration, disclosure or destruction of data, email, password, information or data from personal transactions stored on our website. How we use the collected information
Logyourmessage.com collect and uses the information for the following purposes:- To understand in what way our users as a group use the services and resources provided by our website.
- To improve our offer based on the information and feedback we receive.
- To answer more efficiently to your customer service requests and support needs.
- To periodical send relevant emails about the platform.
Modification and revocation of Lyme services
We believe that you are the owner of your data and that it is important to preserve your access to this data. Therefore, the revocation of authorization is simple and expeditious, with the ultimate goal of eliminating the account and all your personal data stored in the Lyme database. You can stop using our services at any time, although we know that you will never do that. Should you ever decide to do it, just go to your profile and under the "Edit Profile" panel choose the "Delete Account" option. We will no longer keep any personal information of yours but please be advised that your messages will only be deleted when they reach their expiration date. In alternative, you can send us an email at [email protected], expressing your desire to terminate your account. If we discontinue a service, when reasonably possible, you will be informed by e-mail in advance and will have the chance to withdraw your information from that service.
Inactive users
In the continuation of our policies for the collection and processing of personal data, any user who becomes inactive for a period of over three years, without interaction with our platform will have his account automatically deleted.
Enquadramento legal
Tendo em conta o sobredito, a plataforma – Lyme – Log Your Message – deve ser enquadrada em dois contextos diferentes.
A) DA TRADIÇÃO DO CORREIO POSTAL REGISTADO:
Não existe propriamente uma legislação sobre como registar um envio postal. Existe no entanto uma imensa tradição de como o fazer. E o Lyme assegura-se que essa tradição de como fazer, é seguida em absoluto, com as devidas adaptações à realidade digital. Historicamente, foi em Julho 1556, em Inglaterra, que a primeira carta registada foi entregue. E desde ai, o método de como o processo de registo postal era feito, evoluiu até aos dias de hoje, até à forma que todos conhecemos.
Segundo o nº 3 do artigo 5º do Dec. Lei 17/2012 de 26 de Abril, o registo postal é por definição:
"O envio postal quando o mesmo possui garantia de valor monetário fixo contra os riscos de extravio, furto, roubo ou deterioração, fornecendo ao remetente, a seu pedido, uma prova do depósito ou da sua entrega ao destinatário."
E é de facto desta forma, ou de forma muito semelhante a esta, que por todo o mundo, o correio registado, com ou sem aviso de recepção, é distribuído. Importa por isso, primeiramente, que o Lyme siga uma forma de envio e registo que possa ser equiparada e aceite internacionalmente como correio registado postal, pois, se é um serviço de registo, ainda por cima, digital, tem que ser válido em todo o planeta.
Para além do que a Dec. Lei descreve como sendo o serviço registado postal, há a considerar que esse serviço tem ainda algumas características que, embora implícitas, devem ser tidas em conta para esta análise:
1- O correio registado deve ser aceite antes de entregue.
Ou seja, será impossível obter uma aceitação formal por parte do destinatário depois deste ter já recebido a mensagem que lhe é destinada, muito menos se essa mensagem não for do seu agrado. É por isso imperativo que se recolha essa vontade expressa de receber a mensagem antes de essa lha ser entregue.
O Lyme faz isso de duas formas. A primeira é pela utilização do PIN que está incluido na notificação inicial. Este PIN obriga a que seja um utilizador humano a aceitar a notificação que lhe está a ser entregue, pois como tem que ser transferida entre o email de notificação e a plataforma do Lyme, não é possível "robotizar" essa transferência.
Este PIN valida ainda que o utilizador que está a receber a mensagem é, de facto, o utilizador a quem a mensagem se destina pois, é a esse utilizador que a notificação contendo o PIN foi entregue.
Depois do PIN ser transferido manualmente para a plataforma, é ainda pedida uma nova declaração de vontade de receber, sendo obrigatória a acção sobre o botão de aceitação da mensagem.
2- Ao destinatário deve ser dada a opção de recusa da mensagem.
Ou seja, quem recebe uma comunicação, tem que ter a opção de a rejeitar.
O Lyme cumpre este requisito pois o utilizador pode efectivamente rejeitar a mensagem que lhe é endereçada.
3- A posse da mensagem é apenas conseguida depois da aceitação.
Ou seja, o destinatário não deve ter em sua posse a mensagem sem que antes a tenha aceite receber.
Um registo Lyme garante que não é possível ver o conteúdo da mensagem sem ultrapassar previamente o processo de aceitação. Só após a aceitação é que o Lyme mostra o conteúdo da mensagem ao destinatário.
4- O remetente tem que ser informado da entrega, da recusa, ou se a mensagem foi ignorada pelo destinatário.
O Lyme, cumpre com este requisito ultrapassando-o em muito.
O registo com AR tradicional apenas consegue garantir ao remetente que o veiculo (envelope) foi entregue ou não ao destinatário. Podendo o destinatário, no limite, levantar questões complexas sobre se nessa entrega existia alguma comunicação efectivamente ou se o veiculo (envelope) estava vazio ou continha coisa diferente do que era suposto.
O registo do Lyme informa não só o remetente do estado da mensagem (recebida, aceite ou ignorada), como também disso mesmo informa o destinatário. Para além disso, inclui o texto do corpo da mensagem no registo emitido, sendo simples comprovar não só quando e onde foi entregue, mas também o que foi entregue.
Este registo é a "…prova do depósito ou da sua entrega ao destinatário."" exigida pela articulado do Dec. Lei 17/2012.

Quanto à restante definição do nº 3 do artigo 5º do Dec. Lei 17/2012 de 26 de Abril propriamente dita:
5- Protecção contra os riscos de extravio, furto, roubo ou deterioração.
O extravio e a deterioração, uma vez que se trata de um envio digital, não se colocam.
No entanto, o furto ou roubo sim.
É por isso mesmo que o Lyme é encriptado desde o envio à recepção. E é também por isso que, para além da encriptação o Lyme utiliza todos os dispositivos possíveis para dirimir este tipo de riscos. Desde o tamanho e complexidade dos caminhos dos links até à dispersão de IPs e firewalls dos servidores, para evitar todo tipo de ataques ou apropriação ilícita da informação, sendo por isso, a segurança de um envio registado pelo Lyme, imensamente maior do que a do sistema tradicional.
6- Para tudo o supra mencionada deve o fornecedor oferecer uma "… garantia de valor monetário fixo…".
O Lyme garante os seus envios num valor até um máximo de 10 vezes o valor mínimo do custo de envio anunciado, tal como pode ser visto nas condições do serviço do Lyme em: logyourmessage.com/policies
Ainda sobre as normas tradicionais, devemos também ter em conta o que a UPN (União Postal Universal) diz sobre o correio registado com AR. Para além de tudo o que o Dec. Lei refere e o que em cima acrescentamos, diz ainda que o correio registado deve ter um número de identificação único. Também este requisito é cumprido pelo Lyme. O link da mensagem é também o ID público atribuído a cada registo e é único. Mesmo quando o registo deixa de estar válido e é eliminado da plataforma, este número não volta a ser repetido.
B) DO REGULAMENTO (EU) N.º910/2014 DO PARLAMENTO EUROPEU E DO CONSELHO DE 23 DE JULHO DE 2014 – RELATIVO À IDENTIFICAÇÃO ELETRÓNICA E AOS SERVIÇOS DE CONFIANÇA PARA AS TRANSAÇÕES ELETRÓNICAS NO MERCADO INTERNO – "REGULAMENTO EIDAS":
Este regulamento, aplicável a todos os estados membros da União Europeia, visa assegurar a segurança online para as transacções comerciais através da regulamentação das entidades que fornecem serviços de confiança. Assim, todos os prestadores de serviços de confiança estabelecidos na União Europeia estão sujeitos aos requisitos deste regulamento.
Posto isto, cumpre aludir à definição que nos é dada pelo artigo 3.º n.º36 do Regulamento "eIDAS" que elucida que serviço de envio registado electrónico é um "serviço que torne possível a transmissão de dados entre terceiros por meios electrónicos e forneça prova do tratamento dos dados transmitidos, nomeadamente prova do envio e da recepção dos mesmos, e que proteja os dados transferidos contra o risco de perda, roubo, dano ou alteração não autorizada".
Assim, no que à plataforma Lyme diz respeito, é inequívoco que estamos perante uma entidade que fornece um serviço de confiança, pelo que, deve cumprir as obrigações previstas no presente regulamento.
Na verdade, deve haver uma dupla análise aos serviços aqui em causa:
Por um lado estamos perante um serviço de envio registado electrónico, uma vez que de acordo com as características explanadas supra, este serviço cumpre todos os requisitos plasmados neste regulamento.
Por outro lado percebemos que o cumprimento destes requisitos é corroborado pela existência de uma entidade que emite um selo temporal correspondente a cada mensagem enviada, sendo que de acordo com o artigo 3.º n.º 33.º do regulamento "eIDAS" selo temporal consiste na existência de "dados em formato electrónico que vinculam outros dados em formato electrónico a uma hora específica, criando uma prova de que esses outros dados existiam nesse momento".
Ora, tendo em conta tudo o supra exposto, concluímos que estamos perante um serviço absolutamente legal, já que respeita todos os requisitos legais constantes do regulamento “eIDAS”, sendo uma plataforma que oferece serviços de envio registado electrónico (de acordo com os artigos 3.º n.º36 e 43.º do regulamento "eIDAS") em que são apostados selos temporais simples (de acordo com os artigos 3.º n.º33 e 41.º do mesmo diploma legal), motivo pelo qual, de acordo com o presente regulamento, "Não (lhes) podem ser negados efeitos legais nem admissibilidade enquanto prova em processo judicial…" – (Vide artigos 41.º e 43.º do regulamento "eIDAS").

We sometimes use external web services on our website to display content on our page. For example, to make images and video available. In those cases, we can't prevent the collection of information on the uses, by our users, when they access these content embeded in our website.
